These Terms & Conditions (the “Terms”) apply to all trips organized by Dear Colleen Travels LLC, DBA Dear Colleen Travels, (“we,” “us,” or “our”), a State of Florida registered business that can be contacted at the email address dearcolleentravels@gmail.com.

Completing payment of the planning fee, initial trip deposit or any portion of the trip total cost, you acknowledge that you have read, understood, and agreed to these Terms. If you are booking on behalf of others, you accept these Terms on their behalf and confirm that you are authorized to do so.

1. Booking Contract & Acceptance

1.1 A booking is confirmed once your trip questionnaire has been completed and received by Dear Colleen Travels and/or you have completed payment of the required trip deposit and a confirmation email/ invoice confirming the deposit payment has been sent to your email address on file.

1.2 This contract is between Dear Colleen Travels and the person named on the booking confirmation.

1.3 Any special conditions or trip-specific policies provided at the time of booking form part of this contract and may override these general Terms.

2. Planning Fees, Deposits & Payment Plan

2.1 Planning Fees

Certain Travel Services offered by Dear Colleen Travels include a non-refundable planning fee and/ or trip deposit in exchange for the professional travel planning, research, coordination, itinerary development, and other services described for the applicable Travel Service.

Applicable planning fees are as follows:

  • Day Dream: Complimentary

  • Her Woven Way: $50 for trips of 3–5 days; $100 for trips of 6–9 days; $150 for trips of 10 days or more.

  • Golden Hour Retreats: $200, unless otherwise stated in the applicable trip description.

  • A Story Unfolding: Planning fees start at $250. The final planning fee may vary based on group size, trip length, destination, scope of services, and overall planning complexity. The applicable planning fee will be communicated to and approved by the Client before planning services begin.

Planning fees are separate from the cost of travel arrangements, including but not limited to accommodations, cruises, airfare, transportation, excursions, activities, meals, travel insurance, and other supplier services.

2.2 Payment and Commencement of Planning Services

Unless otherwise stated in writing, the applicable planning fee must be paid in full before Dear Colleen Travels begins the planning services associated with the selected Travel Service.

Payment of the applicable planning fee constitutes the Client’s authorization for Dear Colleen Travels to begin providing the purchased planning services and constitutes acceptance of these Terms.

Once planning services have commenced, the applicable planning fee is considered earned and is non-refundable, regardless of whether the Client ultimately books travel arrangements, changes their travel plans, cancels their trip, or chooses not to proceed with the recommended arrangements.

2.3 Scope of Planning Services

Planning fees apply to the scope of services specifically described for the selected Travel Service. Requests that fall outside the stated scope of the selected Travel Service, including substantial changes to the destination, dates, group size, itinerary, or other travel requirements, may be subject to an additional planning fee.

Any additional planning fee will be communicated to and approved by the Client before additional planning services are performed.

2.4 Travel Costs Are Separate

Planning fees paid to Dear Colleen Travels do not constitute payment toward the Client’s travel arrangements unless expressly stated otherwise in writing.

Travel arrangements are subject to the applicable supplier’s pricing, availability, payment schedules, cancellation policies, and other terms. Payment of a planning fee does not guarantee availability, pricing, or booking of any particular travel service.

2.5 Pocket Bestie Concierge Service

The Pocket Bestie is an additional add-on service and is non-refundable once purchased, regardless of utilization frequency. This service is considered delivered in full at the time of trip departure as communication and customer support availability is reserved throughout your travel dates.

2.6 Golden Hour Retreats’ Payment Plan

Payment plans may be offered for select Golden Hour Retreats at the discretion of Dear Colleen Travels. When available, payment plans and their applicable due dates will be provided to the Client in the payment plan and/or invoice issued at the time the Client secures their placement on the trip with the required deposit.

The Client is responsible for ensuring that all payments are submitted in full by the applicable due dates outlined in their payment plan and/or invoice. Failure to make a required payment by its due date may result in forfeiture of the Client’s deposit, cancellation of the Client’s services, and/or removal from the trip without refund, as applicable under the cancellation terms set forth in Section 5 of these Terms & Conditions.

Requests for a payment plan must be submitted in writing to dearcolleentravels@gmail.com prior to securing a placement on the applicable Golden Hour Retreat. Submission of a request does not guarantee that a payment plan will be available or approved. Changes to Services and Pricing

Dear Colleen Travels reserves the right to modify, add, remove, or update its Travel Services and pricing at any time. Any pricing applicable to a Client who has already purchased a Travel Service will be determined by the price communicated to and accepted by the Client at the time of purchase, unless otherwise agreed in writing. The initial deposit to secure your place becomes non-refundable after the standard sign-up deadline has passed.

If the Client elects to forfeit their place on a trip prior to the payment due date, the Client shall forfeit only the payments previously made and will not be responsible for any future payments. However, if a Client elects to forfeit their spot on or after the payment due date, the Client remains fully responsible for any outstanding payments that were due as of the date the Client requested to relinquish placement. 

Bookings made within 60 days of departure require full payment of total travel cost at the time of booking.

2.7 All payments must be made in U.S. dollars and you are responsible for any bank or transaction fees.

2.8 Every trip with Dear Colleen Travels is designed with care and attention to detail. To ensure each experience is seamless, travelers are required to secure their booking within the designated window for the travel service selected. Failure to do so may result in denial of planning services.

Standard Booking Windows:

  • Day Dream – Minimum 3 weeks before travel departure date
  • Her Woven Way – Minimum 90 days before travel departure date
  • Golden Hour Retreats – Deposit required at the time of booking (Section 2.1), due by trip specified signup deadline. Following payments are due by the date distinguished in your payment plan/ invoice (Section 2.4)
  • A Story Unfolding – Minimum 6 months before departure date. Deposit required at the time of booking (Section 2.1)

2.9 Changes to Services and Pricing

Dear Colleen Travels reserves the right to modify, add, remove, or update its Travel Services and pricing at any time. Any pricing applicable to a Client who has already purchased a Travel Service will be determined by the price communicated to and accepted by the Client at the time of purchase, unless otherwise agreed in writing.

3. What’s Included Per Service 

Each Travel Service includes a different level of planning support, depending on your travel needs:

3.1 Day Dream – Complimentary

Day Dream is a complimentary travel planning service and includes:

  • Initial planning consultation phone call
  • Accommodation comparison of 2-3 hotels or cruise sailings
  • Booking of client approved accommodation
  • “Welcome to Your Getaway” pdf
 

3.2 Her Woven Way – Planning Fee Applies

Her Woven Way includes everything listed in the Day Dream service, plus:

  • Destination research and selection support
  • Excursion and activity booking
  • Custom day to day itinerary
  • Dining and transportation recommendations
 

3.3 Golden Hour Retreats – $200 Planning Fee

Golden Hour Retreats include:

  • Pre selected travel destination
  • On-site trip Host
  • All accommodations booked
  • All excursions and activities booked
  • Custom day to day itinerary
  • Surprise welcome gift
  • Pre-trip virtual meet and greet
 

The exact services included in your selected Golden Hour Retreats are listed in the trip description on the website.

The following are typically not included in Golden Hour Retreats unless otherwise specified; airfare, travel insurance, visas, passport fees, optional activities, meals, and personal expenses.

3.4 A Story Unfolding –  Planning Fee Starts at $250

A Story Unfolding is designed for special-event and milestone travel, including but not limited to bachelorette trips, milestone birthdays, graduations, reunions, and other special occasions.

A Story Unfolding includes:

  • Everything listed in Her Woven Way service, unless otherwise specified
  • Custom event mood board
  • Pocket Bestie concierge service
  • “Your Story Awaits” pdf
 
The planning fee starts at $250. The final planning fee may vary based on group size, trip length, destination, scope of services, and planning complexity. The Client will be informed of the applicable planning fee before services begin.
 
3.5 Unless expressly stated otherwise, planning fees do not include the cost of travel arrangements or. supplier services. These may include accommodations, cruises, airfare, transportation, excursions, activities, meals, travel insurance, visas, passport fees, and personal expenses. 

Payment of a planning fee does not guarantee a particular destination, supplier, accommodation, activity, itinerary, price, or availability.

Dear Colleen Travels reserves the right to modify, add, remove, or update its Travel Services and pricing at any time. Any pricing applicable to a Client who has already purchased a Travel Service will be determined by the price communicated to and accepted by the Client at the time of purchase, unless otherwise agreed in writing.

4. Your Responsibilities

4.1 You are responsible for ensuring that all personal information provided (including but not limited to name, birthdate, email address, phone number, mailing address) is accurate and matches your travel documents. 

4.2 You are responsible for notifying us promptly of any errors regarding your information.

4.3 You are responsible for obtaining and/or carrying required travel documentation such as a valid passport, visas, travel insurance (if desired), vaccinations specified by destination and any required medical documentation prior to departure date.

Dear Colleen Travels is not responsible for denied boarding, entry or travel disruptions caused by incomplete on invalid documentation.

5. Cancellations Requested by Client

5.1 Cancellations must be submitted in writing to dearcolleentravels@gmail.com and are effective at the time they are received.

5.2 The following fees or actions apply to late payments unless otherwise stated in your trip-specific Terms:

5.3 No refunds will be made for unused services (such as Pocket Bestie), late arrivals, or no-shows.

6. Cancellations or Changes Made by Dear Colleen Travels

6.1 We reserve the right to modify or cancel a trip at any time due to low enrollment, safety concerns, and/or circumstances beyond our control.

6.2 If we cancel before the trip departure date, you will receive a refund of the initial deposit plus any other payments made directly to Dear Colleen Travels (minus non-recoverable supplier costs). 

6.3 Refunds for accommodations, cruises, excursions, hotels, airfare, transportation, and other travel services are subject to the individual supplier’s cancellation and refund policies. Dear Colleen Travels is not financially liable for any supplier costs or travel services that are non-refundable.

6.4 If cancellation is due to force majeure (e.g. natural disaster, war, epidemic, government restriction, Acts of God, etc.), refunds or travel credits will depend on what can be recovered from suppliers. 

7. Golden Hour Retreats Itinerary Flexibility

7.1 We strive to deliver the advertised itinerary but may need to make changes to accommodations, activities, or transport due to unforeseen circumstances including, but not limited to, force majeure, weather conditions, political events, strikes, health or safety concerns, or decisions made by local travel operators.

7.2 We will make all reasonable efforts to offer a comparable alternative at no additional cost to you.

8. Assumption of Risk & Liability

8.1 You understand that travel involves inherent risks, including but not limited to transportation delays, illness, injury, severe weather, or actions made by third-party suppliers.

8.2 You agree to release, indemnify, and hold harmless Dear Colleen Travels, its employees, contractors, and affiliates from any claims, losses, force majeure, or damages except where directly caused by our gross negligence or willful misconduct.

8.3 In the rare event of our gross negligence or willful misconduct, our total liability will be limited to the amount you paid for the specific portion of the trip directly affected.

8.4 For all services provided, Dear Colleen Travels acts solely as an intermediary between clients and suppliers.

9. Safety & Security Eligibility 

9.1 By agreeing to these Terms, the Client confirms that they have not been convicted of a felony, violent crime, sexual offense, fraud-related crime, or any other offense that could reasonably pose a risk to the safety or well-being of fellow travelers, vendors, partners, or Dear Colleen Travels employees.

9.2 We reserve the right to require a background check as a condition of participation at our discretion. Refusal to complete the background check, or test results that raise concerns, will result in immediate removal from the trip and/or termination of planning services without a refund.

10. Travel Insurance

10.1 Comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, loss of a family member, and baggage loss is not required, but is recommended.

10.2 You are solely responsible for the adequacy and accuracy of your policy.

11. Traveler Code of Conduct

11.1 All travelers are expected to maintain a respectful and inclusive attitude toward their fellow attendees, trip Host(s), and local communities throughout the trip. To help create a welcoming environment for everyone, participants are asked to be mindful when discussing sensitive subjects such as politics, religion, or personal beliefs.

11.2 Travelers must treat all lodging accommodations with respect and refrain from causing damages. Travelers will be held personally financially responsible for any loss and/or damages to the property.

11.3 We reserve the right to remove any traveler (before or during a trip) who is disruptive, unsafe, discriminatory, under the influence of drugs or alcohol in a way that jeopardizes the group and/or does not abide by the agreed Code of Conduct.

11.4 No refund or compensation will be given in the event of trip removal, and the traveler is responsible for your own onward travel arrangements.

12. Use of Photos & Media

12.1 You grant permission to your fellow attendees and your trip Host(s) to capture photos and videos of you while in participation on the trip.

12.2 You grant us permission to use these photos or videos taken during your trip for marketing and promotional purposes, unless you opt out in writing before departure date.

13. Use of Client Feedback & Testimonials 

13.1 “Feedback” means any comment, response, review, testimonials, success story, result, photograph, screenshot, recording or other content you voluntarily submit to Dear Colleen Travels including through: contact forms, surveys, social media posts/ comments, email replies, messages, and any other method of communication. 

13.2 You grant us a non-exclusive, worldwide, royalty-free, transferable, sub-licensable license to use, reproduce, adapt, excerpt, translate, publish and display your Feedback in whole or in part in any medium now known or later developed including illustrations, social media posts, blog posts, email newsletters, website pages and any other form of marketing.

13.3 We may edit Feedback for length, grammar, clarity, and formatting, and may combine feedback you have submitted on separate occasions into a single narrative. We will not edit Feedback in any way that materially distorts your stated experience, and we will not attribute to you a claim you did not make. 

13.4 Feedback is voluntary by the Client and unpaid.

14. Communication Expectations

14.1 Standard communication hours with Dear Colleen Travels are as follows: 

Monday – Friday 9AM – 6PM (EST)

14.2 Premium communication (optional service add-on for Day Dream and Her Woven Way packages) is available with the purchase of the Pocket Bestie service. Pocket Bestie communication hours are as follows: 

Sunday – Saturday 7AM – 12AM (local destination time) 

14.3 You are responsible for providing timely responses and requested information throughout the planning process. Delays in communication may affect the ability to finalize your trip arrangements as requested.

14.4 Communication from your travel advisor is no longer required once you arrive at your destination unless it is an emergency or you purchased the Pocket Bestie service prior to your departure date.

15. Privacy Policy

15.1 Personal data collected only as necessary to arrange your travel.

15.2 We do not share or sell your personal data with or to any other organizations, except when it is required to arrange your travel.

16. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

16.1 Informal Dispute Resolution. Before initiating any arbitration or court proceeding, you and Dear Colleen Travels LLC, agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms, the Travel Services, or your relationship with Dear Colleen Travels LLC, (each, a “Dispute”) informally for at least thirty (30) days. To begin the informal dispute resolution process, you must send a written notice of the Dispute to Dear Colleen Travels LLC, to dearcolleentravels@gmail.com, describing the nature and basis of the Dispute and the specific relief sought. The thirty (30) day informal resolution period begins on the date the notice is received. If the Dispute is not resolved within thirty (30) days, either party may proceed to binding arbitration as provided below.

16.2 Agreement to Arbitrate. You and Dear Colleen Travels LLC, agree that any Dispute that is not resolved through informal dispute resolution shall be resolved exclusively through final and binding arbitration, rather than in court, except as expressly provided in this section. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

16.3 Arbitration Location and Procedure. The arbitration will be conducted in Orlando, Florida or, at your election, by telephone, video conference, or written submissions, in accordance with the AAA Rules. The arbitration will be conducted by a single neutral arbitrator. The arbitrator will be bound by these Terms.

16.4 Arbitration Fees. Payment of all arbitration filing, administrative, and arbitrator fees will be governed by the AAA Rules. Dear Colleen Travels LLC, will reimburse those fees for claims totaling less than $5,000 unless the arbitrator determines the claims are frivolous.

16.5 Arbitrator’s Authority. The arbitrator shall have the exclusive authority to resolve any Dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of this arbitration agreement is void or voidable. The arbitrator shall have the authority to grant any remedy that would otherwise be available in court, including injunctive and declaratory relief, except that the arbitrator may only award individual relief in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

16.6 CLASS ACTION WAIVER. YOU AND DEAR COLLEEN TRAVELS LLC, AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER PARTY ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH YOU AND DEAR COLLEEN TRAVELS LLC, AGREE OTHERWISE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON’S OR PARTY’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING. THE ARBITRATOR MAY AWARD RELIEF ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF NECESSITATED BY THAT PARTY’S INDIVIDUAL CLAIM(S). ANY RELIEF AWARDED CANNOT AFFECT OTHER USERS.

16.7 JURY TRIAL WAIVER. YOU AND DEAR COLLEEN TRAVELS LLC, EACH WAIVE THE RIGHT TO A TRIAL BY JURY IN CONNECTION WITH ANY DISPUTE BETWEEN THE PARTIES.

16.8 Exceptions to Arbitration. Notwithstanding the foregoing, the following Disputes are NOT subject to the arbitration requirement: (i) any Dispute that may be brought in small claims court in Orange County, Florida; (ii) any action by Dear Colleen Travels LLC, to seek injunctive or other equitable relief in a court of competent jurisdiction to protect or enforce Dear Colleen Travels LLC’s, intellectual property rights, including but not limited to copyrights, trademarks, trade secrets, and the confidentiality of the Service materials; and (iii) any other Dispute that applicable law requires to be heard in court.

16.9 30-Day Right to Opt Out. You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to dearcolleentravels@gmail.com within thirty (30) days after first becoming subject to these Terms. Your notice must include your full name, mailing address, email address used when receiving travel planning services, and a clear statement that you wish to opt out of this arbitration agreement. If you opt out, neither you nor Dear Colleen Travels LLC, can require the other to participate in an arbitration proceeding under this section. If you do not opt out within thirty (30) days, you will be deemed to have accepted this arbitration agreement.

16.10 Severability of Arbitration Provisions. If any portion of this arbitration agreement is found to be unenforceable, the unenforceable provision shall be severed and the remainder shall remain enforceable. However, if the Class Action Waiver is found unenforceable, the entire arbitration agreement shall be null and void.

16.11 Survival. This BINDING ARBITRATION AND CLASS ACTION WAIVER section will survive the termination of these Terms.

17. Governing Law & Dispute Resolution

17.1 These Terms are governed by the laws of the State of Florida, USA.

17.2 Any disputes shall be resolved in the courts of Orlando, Orange County, Florida, unless otherwise required by law.

18. Statute of Limitations

18.1 Statute of Limitations: You and Dear Colleen Travels LLC, agree that any cause of action or claim either party has arising out of or related to these Terms or the Services provided must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred. This limitation does not apply where a longer period is required by applicable non-waivable law.

19. Waiver

19.1 No failure or delay by Dear Colleen Travels LLC, to enforce any provision of these Terms shall constitute a waiver of that provision or any other provision. No waiver by Dear Colleen Travels LLC, of any breach of these Terms shall constitute a waiver of any subsequent breach. All waivers must be in writing and signed by an authorized representative of Dear Colleen Travels LLC.

20. Acceptance

20.1 Dear Colleen Travels LLC, reserves the right to make changes to these Terms at any time. The updated Terms will be shared with current travelers and will go into effect immediately.

20.2 If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

20.3 When changes are made to this policy, we will update the “Last Updated” date at the top of this page.
